ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. The occurrence pertains to the year 2018. It can be seen that the complainant had filed Crl.A.No.25 of 2024 and by judgment dated 28.03.2025, the matter was remanded back to the trial Court. At present, the case is pending for examination of the listed witnesses. It is stated that the defacto complainant/LW1 is a German national and has returned to Germany, and Page No.1 of 3

there is absolutely no way to contact her.

3. In view of the above, even though the accused are attending the case, the matter cannot proceed further. Considering the extraordinary nature of the case, and in exercise of powers under Articles 226 and 482 of the Constitution of India, the case in C.C.No.49 of 2020 on the file of the Judicial Magistrate Court, Vanur, Vanur Taluk, Villupuram stands closed, with liberty to the prosecution to approach this Court in the future, if necessity arises, to reopen the case.

4. Accordingly, this Suo Motu Transfer Case stand disposed of. 10.09.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
