ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. The case was registered in Cr.No.38 of 2020 dated 30.01.2020 for the alleged offence under Section 381 of Indian Penal Code, 1860. The occurrence in this case happened on 25.01.2020. The complainant is present and submits Page No.1 of 3

the amount of Rs.4,70,000/- has already been returned to him. The whereabouts of the complainant is not known. It is submitted that A2 had passed away and the case is pending at the stage of non bailabe warrant against other accused.

3. Considering the long pendency, the complainant's stand and the fact that the accused remains untraceable, further continuation would impinge upon the right to a speedy trial. No useful purpose will be served by keeping the matter pending.

4. Accordingly, the case in CC.No.72/2020 on the file of the Judicial Magistrate Court, Kangeyam, Kangeyam Taluk, Tiruppur shall stand quashed and this Suo Motu Transfer Case stand disposed of. 22.09.2025 shl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned. Page No.2 of 3
