Padalam P.S., v. Sasikumar
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 15.09.2025
CORAM:
THE HONOURABLE MR. JUSTICE D.BHARATHA CHAKRAVARTHY Suo Motu TR.No.7870 of 2025 (C.C.No.127 of 2024 of Judicial Magistrate Court No.II, Madhuranthagam Taluk, Chengalpattu) For Petitioner : Mr.S.Sugendran Additional Public Prosecutor
ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.
2. This case was registered in Crime No.163 of 2018 for alleged offences under Section 279, 337 and 304(A) of Indian Penal Code, 1860. The incident occurred in the year 2018. In view of the fact that the defacto complainant has not filed any claim petition, it is seen that even though summons or warrant is pending, despite best efforts the accused could not be traced out. Considering the nature of the allegations, even if summons or warrant is served in future, it would impinge upon the right to speedy trial of the accused.
