ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), 20(b)(ii)(B) of 1/4

NDPS Act, 1985 and Section 123 of BNS Act , 2023 in Crime No.232 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were found in possession of 1.170 kgs of ganja. Hence, the present case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has not committed any offence as alleged by the prosecution. He also submitted that the petitioner is ready to abide by any conditions imposed by this Court. Hence, he prayed that anticipatory bail may be granted to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that the petitioner had supplied banned ganja to A1 and A2, who, in turn, sold the same to the local public for their personal gain. He further reported that there are 18 previous cases registered against the petitioner, out of which two are of a similar nature. Hence, he opposed the grant of anticipatory bail to the petitioner.

Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsel on either side, and the fact that 12 previous cases are pending against the petitioner and that custodial interrogation is required, I am not inclined to grant anticipatory bail to the petitioner .
