The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 63(a), 64 and 65 of Copyright Act, 1957 and under Section 319(2) and 318(4) of BNS and under Section 29 of Trade and Merchandise Mark Act, 1958, in Crime No.434 of 2025, on the file of the respondent police, seek anticipatory bail.

2. The learned Government Advocate (Crl. Side) appearing for the respondent submits that, case has been registered for infringement of copyright and passing off and the same is under investigation.

3. The learned counsel appearing for the petitioner submits that the petitioner is alleged to be manufacturer of counterfeit products using the brand name "DIXCY SCOT."

4. Taking note of the nature of the allegations, this Court is of the view that anticipatory bail cannot be granted, since the search conducted at the premises of the petitioner has led to recovery of incriminating material and 2/4

further the petitioner is absconding and investigation is still in progress.

5. Hence, this Criminal Original Petition stands dismissed. 01.09.2025 bsm To,
