This Writ Petition has been filed to issue a Writ of Mandamus, directing the first respondent to consider the petitioner's representation dated 28.05.2020 and to direct the first respondent to cancel the bogus sale deeds Doc.Nos.1652/2016 dated 29.03.2016 and Doc.No.5408/2018 dated 26.09.2018 registered on the file of the Sub Registrar, Padappai.
2. Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the first respondent.
3. Since there is no adverse order is passed against the private respondents, notice to R2 to R4 is dispensed with.
4. It is the contention of the learned counsel for the petitioner that the petitioner made a representation to the first respondent on 28.05.2020. The first respondent has not given any response to his representation till now. Hence the writ petition.
5. Learned Special Government Pleader appearing for the first respondent submitted that as per the latest circular, they are unable to conduct enquiry and further the issue is pending before the Hon'ble Division Bench of this Court.
6. On a perusal of the records, it is seen that the representation has been given by the petitioner prior to the issuance of circular. Hence the reasons assigned by the learned Special Government Pleader is not acceptable. Since the issue is pending before the Division Bench of this Court, the first respondent is directed to give proper response to the petitioner's representation 28.05.2020 within a period of one month from the date of receipt of a copy of this order.
7. With the abovesaid direction, the Writ Petition is disposed of. There shall be no order as to costs.
