This petition has been filed seeking condonation of delay of 167 days in filing the Second Appeal.

2. Heard both sides and perused the materials available on record.

3. In the affidavit filed in support of the petition, it is stated that after receiving the judgment and decree of the Appellate Court, the petitioner met with an accident.

Hence, the delay has occurred.

4. Though it is opposed by the learned counsel for the respondent, however, considering the averments made in the affidavit filed in support of the petition and the submission made by the learned counsel for the petitioner, the delay is condoned.

Accordingly, the petition is allowed.
