O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Section 123 of BNS Act and Section 24(1) of Cigarettes and Other Tobacco Products Act, 2003, in Crime No.240 of 2025 on the file of the respondent Police, and hence seeks anticipatory bail. 1/3

2. The petitioner apprehends arrest in connection with the seizure of 55 kg of tobacco products. The respondent police have already arrested two persons, one of whom is the brother of the petitioner.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and has been falsely implicated in this case.

4. The learned Government Advocate (Crl.Side) reiterated the prosecution case and vehemently opposed the grant of anticipatory bail to the petitioner on the ground that he is a habitual offender involved in illicit trafficking of tobacco products.

5. Considering the quantity of tobacco products seized in this case, and since the investigation indicates that the petitioner is the supplier of the said contraband, this Court is not inclined to grant anticipatory bail.
