The petitioner who was arrested and remanded to judicial custody on 16.08.2023 for the offences under Sections 6 and 5(1) of POCSO Act, 2012 in Crime No.358 of 2023, seeks bail.

2.The learned counsel for the petitioner stated that the petitioner is aged 19 years and the victim girl is aged 16 years and they were in relationship. It is also stated that the petitioner has been in custody for nearly about 82 days.

3.On the side of the respondent, it is stated that the charge sheet is made ready and would be filed shortly.

4.A reading of the statement of the victim girl recorded under Section 164(5) of Cr.P.C shows that she has reiterated the statements made in the complaint.

5.In view of that particular fact, since the victim girl will have to tender evidence before the trial Court, at this stage, this Court is not inclined to grant bail to the petitioner.
