ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case was registered in Cr.No.121 of 2019 for the alleged offences under Sections 279, 338 and 304 (A) of I.P.C. r/w Section 181 (3) , 196, 190

(2) of the Motor Vehicles Act, 1988. The accident occurred on 03.03.2019. It is reported that the defacto-complainant is not found in the respective address and remains untraceable and it is not known whether any claim petition is filed or not. The matter has been pending since 2019. 3.Considering the factual matrix, context of the case, the reason for absence from his usual place, and the submission that, despite best efforts, the summons could not be served, it is evident that even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. 4.Accordingly, the case in C.C.No.215 of 2022 of Judicial Magistrate Court No-I, Udumalpet, Udumalpet Taluk, Tiruppur, stands quashed. This Suo Motu Transfer Case is disposed of. It is made clear that the disposal of this case shall not, in any manner, affect any claim petition that may be filed in the future.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
