ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case, Cr.No.331 of 2017 was registered for the alleged offences under Sections 4 (1) and 4 (2) (c) of Immoral Traffic (Prevention Act). The allegation in this case is that the accused had got money from the illicit witness for arranging prostitution with the victim. For the said allegation the case is pending from the year 2020. Apart from this there is one more case is of same nature that is of the year 2020. There is no other case after 2020. The accused has been facing the proceedings all along.

3.Considering the nature of the allegation, and the fact that thereafter the accused is not involved in these type of cases one opportunity can be given to the accused and since the accused has been facing the case since 2020, any further continuation of the trial would impinge upon his right to a speedy trial Page No.1 of 2 https://www.mhc.tn.gov.in/judis

4.Accordingly, the case in S.T.C.No.10 of 2021 of Judicial Magistrate Court No-I, Udumalpet, Udumalpet Taluk, Tiruppur, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
