For Petitioner :

For Respondent:

Mr.L.Muralikrishnan Mr.D.R.Arunkumar Standing Counsel for TANGEDGO

ORDER

The Contempt Petition has been instituted to punish the respondents for their willful disobedience of the order of this Court made in W.P.No. 10379 of 2021 dated 08.02.2024.

2.

This Court passed an order in W.P.No.13079 of 2021 dated 08.02.2024, which reads as follows, "6. May that as it be, the letter of the Chief

Engineer/Civil Transmission/Chennai dated 04.01.2018 would indicate that the quantum of compensation has been determined. That being so, the said compensation should be settled in favour of the farmers/land owners either by the respondents directly by making payment to the farmers or through the petitioner/company, as the case may be within a period of eight (8) weeks from the date of receipt of a copy of this order. Simultaneously the petitioner/company is directed to take efforts to continue the stringing works and complete the same without causing any undue delay.

7. Accordingly, the Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed."

3.

Learned counsel for the respondent would submit that pursuant to the orders of this Court, actions were initiated to settle the compensation for the farmers/landowners. Some landowners have already received compensation, while a few are refusing to accept it. Therefore, all necessary steps are being taken to settle their compensation.

4.

Learned counsel for the petitioner would submit that unless passage

is given properly, the petitioner, as a contractor may not be in a position to execute the warrant. This is a dispute that needs to be resolved through negotiation with the respondent, and it cannot be resolved by this Court in the present contempt petition 5.

As far as the directions issued by this Court are concerned, the respondents have initiated actions to settle compensation for some farmers. However, regarding other farmers who are refusing, all necessary actions ought to be initiated. Therefore, the respondents have not committed any willful disobedience of this Court's order.

6.

Accordingly, the Contempt Petition stands closed. 28-02-2025 GD Index:Yes/No Speaking/Non-speaking order Internet:Yes
