ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered for alleged offence under Sections 59(1) of the Food Safety and Standards Act, 2006 and Section 190(1)(a) of the Code of Criminal Procedure. The incident occurred in the year 2018. The allegation in this case is that the accused are selling unsafe food violating the guidelines under Food Safety and Standards Act, 2006. It is stated that they are admitting the crime and submits that they are not indulging in selling such food anymore. Considering the quantity and the nature of the business and the accused have been facing this case from the year 2018, lenient view is taken upon admission. Accordingly, this Court, upon finding the accused guilty, instead of sentencing them to imprisonment, imposes a fine amount of Rs.2,500/- each and the fine amount should be paid in the next hearing before the learned Magistrate.

3. Accordingly, the case in S.T.C.No.662 of 2018 of Judicial Magistrate Court No.I, Udumalpet, Udumalpet Taluk, Tiruppur, stands disposed of. This Suo Motu Transfer Case is disposed of.
