ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. In this matter, both the defacto complainant and the accused are migrant labourers. They have since returned to their native places. In spite of best efforts, whereabouts of both the accused as well as the defacto complainant remain untraceable. On behalf of the prosecution, steps have Page No.1 of 3

been taken to withdraw this case and withdrawal proceedings have already been filed before the trial Court.

3. Considering the nature of allegations in this case and despite genuine efforts, the migrant labourers could not be traced. No meaningful trial is possible and no purpose will be served by keeping this matter pending. Even though withdrawal proceedings have been filed, since this Dedicated Bench has taken up the issue, the case need not remain pending on the file of the learned Magistrate any further.

4. Accordingly, the case in C.C.No.700093 of 2012 on the file of Judicial Magistrate Court No.I, Tiruppur, Tiruppur Taluk, Tiruppur shall stand quashed and this Suo Motu Transfer Case stand disposed of. 11.09.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
