PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to call for the records in DVC.No.9 of 2019 pending on the files of the Hon'ble Judicial Magistrate Court, Thirukovilur and quash the same. ORDER

This Criminal Original Petition has been filed by the petitioners to call for the records in DVC.No.9 of 2019 pending on the file of the Judicial Magistrate Court, Thirukovilur and quash the same.

2. The respondent has filed an application seeking certain reliefs under the Protection of Women from Domestic Violence Act, 2005 and based on the same, the learned Judicial Magistrate Court, Thirukovilur, has taken the case on file as DVC.No.9 of 2019.

3. By passage of time, the parties have decided to bury their hatchet and compromise the dispute amicably among themselves. Accordingly, they have settled the matter through Mediation and a Compromise Agreement has been entered between https://hcservices.ecourts.gov.in/hcservices/

them on 10.02.2020.

4. A Compromise memo, dated 26.02.2020, has been filed before this Court which has been signed by the petitioners and the respondent/defacto complainant and also by the counsel for the petitioners. The petitioners and the respondent are present in person before this Court. In order to identify the respective parties, they have also produced the copies of the Aadhaar Card and they are made part of the record. This Court also enquired both the parties and satisfied that the parties have come to an amicable settlement between themselves.

5. Under such circumstances, no useful purpose will be served in keeping the case pending. This Court in exercise of its jurisdiction under Section 482 Cr.P.C., quashes the case in DVC.No.9 of 2019 on the file of the learned Judicial Magistrate Court, Thirukovilur, against the petitioners.

6. This Criminal Original Petition stands allowed and as a sequel, the proceedings in DVC.No.9 of 2019 on the file of the learned Judicial Magistrate Court, Thirukovilur, is hereby quashed as against the petitioners herein and the terms of Compromise Memo shall form part and parcel of this order.
