The petitioners seek anticipatory bail in Crime No.26 of 2023 registered by the respondent Police for the offences under Sections 120(B), 406 and 420 IPC.

2.Heard the learned counsel for the petitioners and the learned Government Advocate (Criminal side).

3.The case of the prosecution is that the defacto complainant was the owner of a property which had been mortgaged for a sum of Rs.67/-lakhs. The first accused who is a friend of the second accused/second petitioner approached the defacto complainant and offered to repay the mortgage amount. The first accused had paid a sum of Rs.37/-lakhs and another friend of his paid a sum of Rs.30/-lakhs for redeeming the mortgage. Thereafter, they once again pledged the documents for a total sum of Rs.4/-crores and paid a sum of Rs.90/-lacs to the defacto complainant and it is alleged that the remaining Rs.3.10/-crores had been swindled by the accused persons. 1/3

4.It is also stated that the 2nd accused is an Auditor. He is a friend of the 3rd accused. The 1st accused is a Bank Manager. The 1st, 4th and 5th accused are absconding.

5.Taking into consideration of all the factors, and the fact that the accused persons are absconding, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed. 11.12.2023 gd 2/3
