CMP.No.22460 of 2023 in SA.No.1091 of 2008 C.KUMARAPPAN, J This Civil Miscellaneous Petition has been filed to condone the delay of 742 days in filing the application for restoration of the Second Appeal.

2. The learned counsel for the respondent, considering the long delay, would submit that the application may be allowed on payment of some costs.

3. This Court is convinced with the submissions made by the learned counsel for the respondent. Hence, this Civil Miscellaneous Petition is allowed on payment of costs of Rs.2,000/- [Rupees Two Thousand only] to the respondent's counsel on or before 07.12.2023, failing which, this petition will be dismissed without any further reference to this Court.

On due compliance of this order, Registry is directed to restore the Second Appeal and post it before this Court on 11.12.2023.
