Writ petition is filed under Article 226 of the Constitution of India for issuance a Writ of Mandamus, directing the respondents to permit the petitioner's son Pritish Narayanan to continue his studies in IX D section in Asan Memorial Senior Secondary School, No.1, Anderson Road, Cochin House, Chennai-6. O R D E R
The petitioner's son has been studying in the second respondent school in IX standard. There was a quarrel between
the petitioner's son Master.Prithish Narayanan and one Master.Madesh of the same class. Due to the quarrel between the petitioner's son and the said Madesh. The parents of Madesh lodged a complaint on 27.07.2017 to the second respondent, which conducted an enquiry on 01.08.2017. Based on the enquiry, a warning letter was issued on 16.08.2017 and the petitioner's son was transferred from IX-A to IX-D to avoid any further conflict. However, the second respondent is trying to send the petitioner's son out of school. Apprehending the same, the petitioner approached this Court.
2.Heard Mr.R.Sankarasubbu, learned counsel for the petitioner; Mr.T.M.Pappiah, learned Special Government Pleader for the first respondent, Mr.A.R.Karunakaran, learned counsel for the second respondent and Mr.G.Nagarajan, learned standing counsel for the third respondent.
3.When the matter was called on earlier occasion, this Court directed the petitioner to take his son again to the school, wherein the affected student along with the parent would also be present, so that the matter could be amicably settled. 4.The matter is called today. It is represented by the learned counsel for the petitioner as well as by Mr.A.R.Karunakaran, learned counsel for the second respondent that both the parents were called along with their children and they were counselled. The second respondent/school convinced with the compromise and decided to permit the petitioner's son to continue in same school. In view of the above development, no further order is necessary, as the petitioner's son is continuing in the same school. Accordingly, this writ petition stands closed. No costs. Consequently, connected miscellaneous petition is also closed.
