Mr.R.Arumugam, learned counsel for applicant in all these four applications and Mr.G.Abraham Prabhu of BFS Legal (Law Firm) on behalf of respondent in all the four applications are before this Court. All these four applications have been filed under sub-section (5) of Section 29-A of 'The Arbitration and Conciliation Act, 1996 (Act No.26 of 1996), which shall hereinafter be referred to as 'A and C Act' for the sake of brevity with a prayer for extending the time for Arbitral Tribunal to make an award.
3. Both the learned counsel make a common submission in unison that the prayer for extension of time may pleased be acceded to. As this order is being passed with the consent of both sides, it is not necessary to dilate on facts. It is also not necessary to enter upon any debate on legal aspects either. Suffice to say that circumstances under which award could not made within the stipulated 18 months period (12+6) have been articulated in Paragraphs 2 to 6 of the affidavits filed in support of these four applications and in the considered view of this Court contents of these paragraphs made out sufficient cause for extension. To be noted, extension of time is sought by three months.
