(a) for recovery of money from the defendant, a sum of Rs.1,22,04,864/- along with interest @ 18% per annum on the principal unpaid loan amount of Rs.1,11,71,500/- from the date of the presentation of the plaint till the date of its realisation, and (b) for costs of the suit.

2. Learned counsel appearing for the plaintiff has filed a Memo, dated 04.01.2026 stating that the dispute has been amicably settled between the parties out of Court. Hence, while recording the said Memo, the suit is dismissed as settled out of Court. The entire Court fee is directed to be refunded to the plaintiff as per the Rules in force. Consequently, the application in A.No.2809 of 2025 is closed. There shall be no order as to costs.
