This writ petition has been filed to direct the respondents to dispose of the petitioner's representations dated 7/10/2022, 17/10/2022, 26/10/2022 and 18/11/2022, respectively seeking to pay the interest due on the arrears of drop in pension, paid in July 2022 may be paid to the drop-in-pension beneficiaries as early as possible.
2. Brief facts which are necessary for the disposal of the writ petition are as follows:- The petitioners 1 to 3 are retired Office Superintendent in Chennai Port Trust and fourth petitioner was Senior Chargemen. They were retired on 31/1/2001, 31/1/2001, July 2001 and 28/2/1998, respectively. On 2/4
2/8/2000, wage revision of Class III & IV Port & Dock Employees was done through wage settlements between the Port Management and Major Federations of Port & Dock workers under Section 12 (3) of the Industrial Disputes Act, 1947. The last wage settlement was signed on 2/8/2000 between the Port Management and Labour Federations. It was effected for the period 1/1/1997 to 31/12/2006. Hence, the petitioners have submitted representations dated 7/10/2022, 18/11/2022, 26/10/2022 and 17/10/2022, respectively to the first and second respondents to consider their representations. Since there was no response, petitioners have come forward with the instant writ petition.
3. Heard Ms.S.Vennila, learned counsel for the petitioners and Mr.S.Haja Mohideen Gisthi, learned counsel for the respondents.
4. Without going into the merits of the case, this Court direct the respondents to consider the representations of the petitioners dated 7/10/2022, 18/11/2022, 26/10/2022 and 17/10/2022, and pass appropriate orders, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. 3/4
