C.V.KARTHIKEYAN, J.

The petitioner/A6 seeks bail in R.R.No.23 of 2023 in NCB F.No.48/1/10/2023/NCB/MDS registered under Section 8(c) r/w Section 20(b)(ii)(c), 27, 28, 29 NDPS Act. The petitioner had been remanded to judicial custody on 29.07.2023.

2.It is the case of the prosecution that A1 to A5 had illegally transported 432.7 Kgs of ganja through a Tata Truck bearing registration No.TN31-BD-6347, which was intercepted at Karanodai on 24/25.07.2023. A1 to A5 were remanded to custody on 27.07.2023. The petitioner was thereafter taken into custody and remanded. 3.The learned counsel for the petitioner stated that the petitioner was arrested and remanded to custody and there has been no recovery from the petitioner herein and that the petitioner is totally innocent of the entire offence.

4.A counter has however been filed by the respondent, wherein, it is stated that the investigation till this stage had revealed that it is this petitioner and another accused Jahir Hussain and Allahpitchai, who had financed the entire drug trafficking operation including transporting it from Andhra Pradesh, handing it over to Srilankan smugglers and procuring it from Orissa - Andhra Pradesh border through cultivators. 5.Since investigation is at nascent stage and since the petitioner is the brain behind the entire operation and had also financed the entire operation and huge quantity of Ganja is involved, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
