ORDER

This writ petition has been filed to restore the electricity service connection to its original position with respect to the subject property.

Heard Mr.K.Sharath Chandran, learned counsel for the petitioner and Mr.L.Jai Venkatesh, learned Standing Counsel for Respondents 1 and 2 and Mr.D.B.R.PRabhu, learned counsel for 3rd respondent.

It is seen from records that the petitioner filed a suit in CS No.1090 of 2008 for the relief of partition and for allotment of 1/3rd share in the suit property and for a permanent injunction. This suit came to be dismissed by judgement and decree dated 04.09.2019. Aggrieved by the same, the petitioner filed an appeal in OSA No.85 of 2020. The Division Bench of this Court by an interim order dated 28.02.2020 ordered status quo. When this order was in force, the 4th respondent is said to have executed a sale deed dated 12.03.2025 in favour of the 5th respondent which was registered as document No.352 of 2025 and based on the same, the 5th respondent applied for service connection and the service connection has been granted in the name of the 5th respondent. The petitioner on coming to know of this fact submitted a representation to the respondents 1 and 2 on 25.08.2025 to restore the service connection to its original position. Since the same was not acted upon, the present writ petition has

been filed before this Court.

The Division Bench through an interim order dated 28.02.2020 had granted status quo specifically against alienation of the property. Inspite of the same, the 4th respondent has sold the property in favour of the 5th respondent and the 5th respondent has managed to get the service connection in their name. All these had taken place in the teeth of the interim order passed by the Division Bench of this Court. Hence, there shall be a direction to the 2nd respondent to deal with the representation made by the petitioner on 25.08.2025 and the 2nd respondent shall take note of the interim order passed by the Division Bench on 28.02.2020 and take a decision within a period of four weeks from the date of receipt of a copy of this order, after issuing notice to the 5th respondent. 5.

This writ petition is disposed of with the above directions. No costs. Consequently, the connected miscellaneous petition is closed.
