Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent to pay the petitioner the amount of Rs.31,215/- payable as wages towards 60 days of earned leave surrendered by him, while he was in service as admitted by the respondent in their RTI, together with 15% interest from the date of his retirement, and to pay him a sum of Rs.17,300/- towards STERBS (State Transport Employees Retirement Benefit Scheme), which was deducted from his salary for every month, while he was in service, together with interest at the rate of 12% per annum, within a specified time as may be fixed by this Court and award costs. 1/4

By consent, this writ petition is taken up for final disposal at the SR stage itself.
2.In the affidavit filed in support of the writ petition, it had been stated that the petitioner had joined the respondent Transport Corporation as a Driver on 11.03.1992 and retired from service as Special Grade Driver upon attaining the age of superannuation on 31.05.2017. It had been stated that there has been a delay in payment of Rs.31,215/- payable as wages towards 60 days of earned leave surrendered by him, while he was in service; a sum of Rs.18,300/- towards STERBS contribution, the petitioner had given a representation to the respondent on 19.05.2025. 3.Heard the learned counsel for the petitioner and the learned standing counsel appearing for the respondent. 4.In the light of the above, a direction is hereby given to the 2/4
respondent Corporation to examine the petitioner's Service Register and to verify whether the above payments are due and payable to the petitioner, if it is due, the same shall be paid to the petitioner with interest at 6% per annum for the delay period. The entire exercise shall be completed within a period of three (3) months from the date of receipt of a copy of this order. If there is any delay in paying the same beyond the stipulated time, then the rate of interest would be calculated at the rate of 12% per annum from the date on which the amount became due and payable till the date of actual disbursement. 5.With the above directions, this Writ Petition stands disposed of. No costs.
