Writ Petition filed under Article 226 of the Constitution of India praying to pass orders, directions, writs in particular a Writ of Mandamus, directing the respondents herein to forthwith pay family pension to the petitioner's family members having regard to the order passed in W.P.No.35524 of 2005 (T) dted 29.09.2009.

O R D E R

The case of the petitioner is that the petitioner's husband was worked as Head Constable in Dharmapuri District and retired from service on 24.07.2019. He was passed away on 18.07.1987. Thereafter, the petitioner claimed the family pension on account of his death. When the same was not forthcoming, therefore, she filed O.A.No.4499 of 1998, before the Tamil Nadu Administrative Tribunal, the tribunal transferred the O.A.No.4499 of 1998 this Court, which was re-numbered as W.P.No.35524 of 2006, after hearing arguments this Court dispose the writ petition and directed the petitioner to give an appropriate application to the second respondent and the second respondent is directed to forward the same to the first respondent for appropriate sanction of the pension and other amounts. Based on the same, the petitioner sent an application, till date the respondents has not consider her proposal and also has not been obeyed the order passed in W.P.No.35524 of 2006 https://hcservices.ecourts.gov.in/hcservices/

dated 29.09.2009. Challenging the same the present writ petition was filed.

The learned counsel appearing for the petitioner would submit it would be suffice to issue directions to the respondents to consider the representation dated 04.10.2019 submitted by the petitioner and to comply with the order passed in W.P.No.35524 of 2006 dated 29.09.2009 within a reasonable time.

3. Mr.A.N.Thambi Durai, learned Special Government Pleader appearing for the respondents agreed to dispose of the representation dated 04.10.2019 within a reasonable time and to comply with the order passed in W.P.No.35524 of 2006 dated 29.09.2009.

4. Without expressing any opinion on merits of the case and considering the limited request made by the learned counsel for the petitioner, I am inclined to issue direction to the respondents to dispose of the representation dated 04.10.2019 and to comply the order passed in W.P.No.35524 of 2006 dated 29.09.2009 and pass orders within a period of Twelve (12) weeks from the date of receipt of a copy of this order. With the above directions, the Writ Petition is disposed of. No costs.
