J U D G M E N T

This Criminal Appeal is filed by the appellant/ 2nd accused challenging the judgment dated 25.11.2022 in Sessions Case No.45 of 2019 on the file of the learned Additional Sessions Judge, Krishnagiri. 2.

The trial court had convicted the appellant for offences under Sections 304(ii) and 324 IPC and imposed a sentence of 5 years rigorous imprisonment and a fine of Rs.1,000/- in default to undergo 3 months simple imprisonment for 304(ii) IPC and 1 year rigorous imprisonment for 324 IPC. This Court, by order dated 20.02.2023 in Crl.M.P.No.19462 of 2022, suspended the sentence imposed on the appellant and he was released on bail.

Today, when the appeal was taken up for hearing, the learned Government Advocate (Crl.Side) appearing for the respondent by producing the Death Certificate of the appellant dated 29.04.2024 and based on the instructions and the Officer who is present in Court, namely, 'Mr.K.Madhappan, SSI 262 KRP Dam PS, Krishnangiri District', submitted that the appellant had died on 26.11.2023 and the appeal got abated. 2/4

In view of the fact that the sole appellant died on 26.11.2023 and no further steps have been taken, the appeal abates under Section 394 Cr.P.C.
