Respondents Prayer : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents 1 and 2 to remove the encroachment made by respondents 3 to 5 in S.No.34/8, Kendapalli village, Krishnagiri Taluk, Krishnagiri District by considering the representation dated 27.11.2023 consequently retrieve the said land for cremation purpose by putting fence.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Petitioner's case is that the land around the village crematorium has been encroached by private respondents, namely, respondent Nos.3, 4 and 5.

2. Shri Prabakar states that notice has already been issued to respondent No.3 for removal of encroachment. Shri Prabakar states encroachment is by way of cultivating the land around the crematorium for personal use.

3. Shri Prabakar states that notice will also be issued to respondent Nos.4 and 5, after making necessary enquiry. Statement is accepted as an undertaking to the Court.

4. In view thereof, petition is disposed of. There shall be no order as to costs.
