The petitioner seeks bail in Crime No.125 of 2023, registered by the respondent police for the offences punishable under Sections 448, 324, 386, 506(ii) of IPC r/w Section 34 of IPC. The petitioner had been remanded to judicial custody on 19.09.2023.

2.It is stated that all the accused persons had joined together and had gone into the construction place and assaulted the North Indians, who were doing work over there. Those workers had come over for their livelihood and they were doing honest work there. There was no provocation. There was no necessity for the petitioner herein to go over there and assault them.

3.So far as this petitioner is concerned, it is stated that he is a history sheeter and there are 13 previous cases against him, seven of which are pending, two are under investigation and he had been acquitted in three cases but in one case he had been convicted.

4.It is the contention of the learned counsel for the petitioner that the petitioner is innocent of the offence and other accused had been granted bail. But however, counter affidavit had been filed wherein it is very specifically stated that the family of the defacto complainant are very much afraid since the petitioner herein is a notorious criminal and he would take revenge against them. It had also been very specifically stated that he is a history sheeter.

5.It is also stated that video coverage is also available for the offence and the vehicles, mobile phone and other articles had also seized by the Investigating Officer at the place of occurrence. 6.Taking into consideration the seriousness of the offence and that the bad antecedents of the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
