ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case in C.C.No.20 of 2020 was taken on the file of the Judicial Magistrate II, Attur Taluk, Salem, for the alleged offence under Sections 379 of I.P.C. The occurrence is said to have taken place on 25.11.2018. The accused committed theft of defacto-complainant's bike. It is reported that the property involved in this case has been recovered. It is reported that the defacto-complainant is not found in the respective address and remains untraceable and hence, the property recovered in this case is in the custody of the Court. At any time, if the de-facto complainant approach the Court, the property can be returned to the de-facto complainant. It is reported that the accused has been attending the Court regularly. 3.Considering the nature of the allegation, the antecedents of the accused and since the accused has been facing the case since 2019, any further continuation of the trial would impinge upon his right to a speedy trial of the accused and no useful purpose would be served. 4.Accordingly, the case in C.C.No.20 of 2020 of Judicial Magistrate II, Attur Taluk, Salem, stands quashed. This Suo Motu Transfer Case is disposed of.

15.10.2025 mp electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
