The petitioner is A4 in Crime No.402 of 2017, registered by the respondent for the offences punishable under Section 395 of IPC. Subsequently to investigation, final report had been filed and the same had been taken cognizance as P.R.C.No.05 of 2018 by the Judicial Magistrate, Uthangarai in Krishnagiri District. 2.It is stated by the learned counsel for the petitioner that the petitioner had been in custody for a considerable period of time but however, as against A1, A2 and A3, Non-bailable warrant is pending. So long as that fact remains, the Judicial Magistrate can never commit the case to the Court of Sessions.

3.In view of that particular fact, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
