Petition filed for direction to the Judicial Magistrate II, Krishnagiri to expedite the trial in C.C.No.130 of 2016.

2. The said case arising out of a complaint registered in Crime No. 32 of 2005 by the respondent police on 28.10.2005 for the offences under Sections 406 and 420 of IPC. From the daily status, this Court finds that, trial in this case not yet completed inspite of summons served to the list of witnesses 1 to 3, since they have not turned up to depose for more than one year. The next hearing date for examining LW1 to LW3 slotted to 01.12.2023. It is a case where even after taking cognizance, trial could not be proceeded for 7 years without any progress. From the case, it is also seen that, the prosecution witnesses have not turned up to give evidence inspite of service of summons.
3. In the light of the above, this Criminal Original Petition is disposed of giving direction to trial Court to ensure the examination of winesses without further delay and complete the trial within a period of four months from today.
