Mr.P.Harish, learned Government Advocate, takes notice on behalf of the respondents. With consent of both sides, the main Writ Petition is taken up for final disposal at the stage of admission itself.

2. This Writ Petition has been filed challenging the order of the 2nd respondent dated 25.08.2025 and to quash the and subsequently direct the 2nd respondent to register the petitioner's document viz., Deed of Revocation of General Power of Attorney dated 25.08.2025.

The learned counsel for the petitioner would submit the petitioner purchased a vacant land comprised in Old S.No.1/1G and New S.No.1G/294A1B1 measuring an extent of 0.17.45 cents situated at Sholinganallur Village, Kancheepuram District and the same was registered on the file of Sub Registrar Office, Neelankarai. Further, he would submit that at the time of registration of the Sale Deed, the petitioner was residing at 2/8

Door No.69, 2nd Main Road, VGP Layout, 3rd Part, Palavakkam, Chennai-41. Thereafter, the petitioner shifted his residence to No.C 131, 2nd Street, Gandhi Nagar, Thaiyar Kullam, Kancheepuram. Whileso, on 11.07.2019, the petitioner executed a General Power of Attorney in favour of one Saravanan and the same was registered on the file of Sub Registrar, Joint 2 Kancheepuram. Thereafter, due to his personal reasons the petitioner decided to cancel the above mentioned deed of general Power of Attorney and accordingly on 25.08.2025, he presented the Deed of General Power of Attorney before the 2nd respondent. But the 2nd respondent by comparing the Sale Deed, refused to register the same on the ground that there is variation in the residential address of the petitioner and directed the petitioner to present the Deed of Revocation of General Power of Attorney before the jurisdictional S.R.O. Hence, the petitioner is before this Court by way of the present Writ Petition.

4. Since, in the affidavit filed in support of his Writ Petition, the petitioner failed to mention his old residential address where he was residing at the time of registration of the Sale Deed, this Court directed the learned 3/8

counsel for the petitioner to file necessary affidavit.

When the matter is taken up today, the learned counsel for the petitioner has filed the affidavit of the petitioner dated 12.09.2025, stating that at the time of registration of the Sale Deed, the petitioner was residing at Door No.69, 2nd Main Road, VGP Layout, 3rd Part, Palavakkam, Chennai41. Thereafter, the petitioner shifted his residence to No.C 131, 2nd Street, Gandhi Nagar, Thaiyar Kullam, Kancheepuram.

The learned Government Advocate appearing for the respondents would submit that since there is variation in the residential address of the petitioner in the aforesaid document when compared to Sale Deed, the 2nd respondent refused to register the same. Further, he would submit that since affidavit has been filed with regard to change of address, appropriate orders may be passed.

8. In the case on hand, at the time of registration of Sale Deed, the petitioner was residing in Palavakkam, Chennai and hence the said document reflects the old address. Thereafter, the petitioner shifted his residence from Palavakkam to Thaiyar Kullam, Kancheepuram and therefore presented the Deed of Revocation of General Power of Attorney, before the 2nd respondent who is the jurisdictional authority. But the 2nd respondent has refused to register the same on the ground that there is change of address in the said document in comparision with the Sale Deed.

9. Considering the facts and circumstances of the case and also recording the affidavit filed by the petitioner dated 12.09.2025, this Court is inclined to set aside the impugned order.

10. Accordingly, the order dated 25.08.2025 passed by the 2nd respondent is set aside. The petitioner is directed to present the Deed of Revocation of General Power of Attorney dated 25.08.2025, along with relevant proof for his new residential address and on production of the same the 2nd respondent is directed to register the said document, if it is otherwise 5/8

in order.
