PRAYER: Criminal Original Petition has been filed under Section 439(1)(B) of Cr.P.C. praying to modify the conditions that the petitioner/accused is ordered to be enlarged on bail on his executing a bond for a sum of Rs.10,000/- with two sureties, of which one must be a blood relative and the other must be a person residing within the jurisdiction of Sathyamangalam Taluk, for the like sum each to the satisfaction of the learned Judicial Magistrate, Sathyamangalam, with further conditions in Crl.MP.No.3789 of 2023 dated 31.10.2023, before the Principal District and Sessions Judge, Erode. 1/4

ORDER

This petition has been filed to modify the condition imposed on the petitioner/accused in Crl.MP.No.3789 of 2023 dated 31.10.2023, by the Principal District and Sessions Judge, Erode, ordered to be enlarged on bail on condition to execute bond for a sum of Rs.10,000/- with two sureties, of which one must be a blood relative and the other must be a person residing within the jurisdiction of Sathyamangalam Taluk, for the like sum each to the satisfaction of the learned Judicial Magistrate, Sathyamangalam.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing on behalf of the respondent police.

3.Taking into consideration the facts and circumstances of the case, the condition imposed on the petitioner is modified to the effect that, one blood surety and another relation who must file an affidavit that he is actually a relation to the petitioner and giving the nature of relationship. Two weeks time is granted to comply the condition. 4.Accordingly, this criminal original petition is ordered. 10.11.2023 KP To
