PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to dispose the representation dated 03.9.2024 and consequently issue patta in favour of the petitioner for the property situated in Town Survey No.185 at No.10, Gandhi Nagar Street, Thiruvannamalai Town.

ORDER

The petitioner, who had inherited the property, which is the subject matter of this writ petition, on account of the death of her husband and who has sought for a transfer of patta in her name on 03.9.2024, has not been called even for an inquiry and therefore, she is before this Court seeking a direction to the third respondent to issue patta.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader accepting notice for the respondents.

3. The case of the petitioner is that in the year 2002, the subject property was settled in favour of her husband. He constructed a house and was residing in the said premises till he died in the year 2019. Thereafter, the petitioner made a representation dated 03.9.2024 to the respondents and sought for patta with reference to the subject property. However, the said representation is yet to be taken up for consideration. Hence the writ petition.

4. On perusal of the records, it is seen that the petitioner made a representation on 03.9.2024 to the respondents for the grant of patta. 2/4

The respondents are required to dispose of such representations at the earliest. However, the respondents have not chosen to dispose of the petitioner's representation for the grant of patta.

5. Hence, the writ petition is allowed and a Mandamus is issued to the third respondent to forthwith consider the representation of the petitioner dated 03.9.2024 for the grant of patta and pass orders thereon within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
