O R D E R

This petition has been filed seeking to set aside the return docket order in C.C.No.112 of 2022 dated 29.11.2022.

2. The petitioner is the third accused in C.C.No.112 of 2022 on the file of the learned Metropolitan Magistrate for trial of Land Grabbing - II at Egmore, Chennai for offences under Sections 419, 465, 467, 468, 471, 34 & 109 of I.P.C seeking to discharge petition from the case in C.C.No.112 of 2022. The trial Court finding that the petition has been filed after framing of charges, had returned the same as not maintainable. Challenging the same, the present petition has been filed.

3. On 15.10.2024, there was no representation for the petitioner.

4. The learned Government Advocate (Crl.Side) would submit that consequent to the filing of the petition before this Court, the petitioner is not interested in pursuing the matter. The trial Court, after framing of charges, had proceeded the examination of witnesses and out of 17 witnesses, 6 witnesses have been examined so far, and the case is now posted for trial for further examination of witnesses on 12.12.2024.

5. In view of the above, no purpose would be served in keeping this petition pending.

6. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected Crl.M.P is closed.
