Prayer: Writ Petition is filed under Article 226 to issue a Writ of Mandamus directing the 2nd respondent to consider appeal dated 24.08.2024 of the petitioner and to take necessary legal action for sub division and issue separate patta in the name of the petitioner in respect of his own properties measuring about 0.17.84 ares comprised in survey No.24/14 A1, (property measuring about 0.06.0 ares comprised in New Survey No.24/14A, 24/18A) and Survey No.22/7C and 22/8, in total 0.67 cents situated at Sankilikuppam Village, Melmalaiyanoor Taluk, Villupuram District.

Aggrieved by the fact that his appeal filed on 24.08.2024 2/7

challenging the rejection of his request for subdivision and transfer of patta has not been considered to date, the petitioner is before this Court.

2. Heard the learned counsels on the either side and perused the records.

3. The petitioner who had obtained title to the property on the basis of a partition deed and exchange deed had applied for subdivision of the property and for issue of separate patta. The said request has been turned down based on the objections raised by the sons of the petitioner's brother. Challenging the said order, the appeal has been filed on 24.08.2024 and the same is still pending.

4. Therefore, mandamus is issued to the 3rd respondent to dispose of the said appeal, within a period of 12 weeks from the date of receipt of a copy of this order, after affording opportunity of 3/7

personal hearing to the petitioner and objectors.

5. With the above observation, the Writ Petition is allowed. No costs.
