Respondents Prayer: Petition filed under Article 226 of the Constitution of India, seeking a writ of mandamus, directing the respondents 1 to 4 to remove the illegal encroachment of the respondents 5 to 10 on the petitioner's land in S.No.36/4 and 33/8C of an extent of 1.95 acres in Thumbipady Village, Omalur Taluk, Salem District, by reconfirming the measurement already made on 06.02.2018 by the respondents 1 to 4 in pursuance of the order of this Court dated 06.07.2015 passed in W.P.No.19747 of 2015.

ORDER

(Order of the Court was made by R.SURESH KUMAR, J.) Mr.P.Vennitharan, learned counsel appearing for the petitioner, after some arguments, wants to withdraw this writ petition with liberty to approach the appropriate forum, including punitive action against the private respondents, who have encroached upon his property without authority of law, by filing appropriate petition under the Procedure Code.

2. Hence, recording his submissions, this writ petition stands dismissed as withdrawn with the aforesaid liberty. However, there shall be no order as to costs.
