ORDER
This writ petition has been filed by the petitioner for transferring the enquiry proceedings in Na.Ka.No.3308462/ 2024/ Aa3 from the 3 rd respondent to the file of 5 th respondent and to pass order under the Patta Passbook Act.
2.Mr.P.Ganesan, learned Government Advocate, takes notice on behalf of the respondents 1 to 5. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself. 3.Learned counsel for the petitioner would submit that the petitioner wrongly filed the petition under the UDR Scheme for correction in the patta, he supposed to have filed the petitioner under the Patta Passbook Scheme. Therefore, the present writ petition has been filed to transfer the case from the rd respondent to 5 th respondent, who is the competent Authority to pass orders under the Patta Passbook Act.
4.Learned Government Advocate appearing for the respondents 1 to 5 would submit that once the application is filed for corrections under the UDR Scheme, it cannot be transferred. Under such circumstances, the petitioner can only file fresh application under the Patta Passbook Scheme.
5.Heard the learned counsel for the petitioner as well as the learned Government Advocate appearing for the respondents 1 to 5 and perused the materials available on records.
6.Considering the submissions made by either parties, it appears that since the application has been filed by the petitioner under the UDR Scheme for corrections, it cannot be transferred to the 5 th respondent under the Patta Passbook Scheme since the 5 th respondent itself forwarded the proceedings to the 3 rd respondent on the ground that the 3 rd respondent has power to carryout the correction under the UDR Scheme. Now, it is only for the petitioner to make fresh application under the Patta Passbook Scheme. When such being the case, this writ petition stands dismissed with liberty to the petitioner to make fresh application under the Patta Passbook Scheme.
