C.V.KARTHIKEYAN,J.

The petitioner seeks bail in S.C.No.248 of 2022, now pending before the XXI Additional Sessions Judge, Chennai, where, the petitioner is arrayed as A13. The charges which had been framed are under Sections 147, 148, 341, 302 r/w 149 of IPC.

2.It is stated that a Non-bailable Warrant had been issued against the petitioner herein on 03.08.2023 and he was secured on 21.08.2023. But, unfortunately A8 and A14 are still absconding and NBWs are still pending against them. As against A11 NBW was also pending. But it is informed that he had been secured in yet another case and he would be produced under Prisoner in Transit warrant. 3.Taking into consideration the fact that if as a convention one after other accused take a decision to abscond, the trial can never end and in view of the fact that NBWs are pending as against A8 and A14, I am

not inclined to grant bail to the petitioner. But however I would give liberty to the petitioner to file an application again, the minute A8 and A14 are also secured.

4.Accordingly, this Criminal Original Petition stands dismissed.
