Prayer: Application has been filed under Order XIV, Rule 8 of O.S.Rules read with Section 151 of the Code of Civil Procedure, 1908 praying to record the death of the 5th defendant and 6 to 9 defendants who are already on record may be recognized as the legal representatives of the deceased P.T.Parthasarathy, the 5th defendant in C.S.No. 566 of 2019.

ORDER

This application has been filed by the applicant/plaintiff seeking to record the death of the 5th defendant and the legal heirs of the 5th defendant who are already arrayed as parties in the suit as the defendants 6 to 9. Therefore, the same has to be recorded.

No objection has been raised by the respondents for allowing this application.

Since the 5th defendant died, the legal heirs of the 5th defendant who are already arrayed as parties in the suit as the defendants 6 to 9.

Considering the reasons stated in the affidavit, and the facts and circumstances of the case, this Court is inclined to allow this petition. 5.

Accordingly, this petition is allowed. No costs. 08-09-2025 MSM Note: Registry shall carryout necessary amendment and list the suit on 22.09.2025 as last chance.
