O R D E R

This petition has been filed by the petitioner seeking to withdraw the case in H.M.O.P.No.1692 of 2022, pending on the file of Addl. Family Court, Coimbatore, and transfer the case to the file of Family Court, Chennai.

2. The learned counsel for the petitioner submitted that the marriage between the petitioner and the respondent was solemnized on 02.12.2019. He further submitted that the petitioner has been tortured at the hands of the respondent and his family members. Thereafter, the respondent filed H.M.O.P. No.1692 of 2022 on the file of the Addl. Family Court, Coimbatore praying to dissolve the marriage. He further submitted that the petitioner is residing at Chennai with her aged parents and it is very difficult for the petitioner to attend the court hearings at Coimbatore. Hence, he prays to transfer the H.M.O.P. No.1692 of 2022 to the Family Court, Chennai.

3. The learned counsel for the respondent has raised objections in allowing the petition and stated that transferring the case to the Family Court, Chennai, would cause great inconvenience to the respondent and it may also be kindly 2/4

taken into consideration by this Court.

4. Considering the facts and circumstances of the case and also the fact that the petitioner is residing at Chennai along with her aged parents, the reasons stated by the petitioner and the same is justifiable. Accordingly, the present Tr.C.M.P. is allowed and the H.M.O.P. No.1692 of 2022, pending on the file of the Family Court, Coimbatore, is withdrawn and transferred to the file of the Family Court, Chennai. Consequently, connected miscellaneous petition is closed. No costs.
