This Petition has been filed to condone the delay of 77 days in filing the above appeal.

2.Mr.S.Arunkumar, learned counsel takes notice on behalf of R2.

3.Having satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 77 days is condoned subject to the condition that the claimant/petitioner will not be entitled to any interest for the delay period i.e., for 77 days, in the appeal.

4.Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same for admission.

5. Registry is further directed to print the name of the Mr.S.Arunkumar, learned counsel appearing for R2 and delete the name of Mr.J.Michael Visuvasam, learned counsel in the cause list, at the time of admission.
