PRAYER; This petition is filed under Article 226 of Constitution of India, to issue a writ of Mandamus directing the 2nd respondent to extend the time period for inclusion of name in the birth certificate and consequently direct the 4th respondent to issue the birth certificate to the petitioner daughter by inserting her name.

ORDER

This petition has been filed seeking a direction to the 2nd respondent to extend the time period for inclusion of name in the birth certificate and consequently direct the 4th respondent to issue the birth certificate to the petitioner daughter by inserting her name.

2. It is the case of the petitioner that the petitioner's daughter V.Shivani was born on 17.03.1993 and on 23.03.1993 her birth was registered. Thereafter, her birth certificate was issued by the 4 th respondent on 02.02.1996, which was obtained by the petitioner without mentioning his daughter's name in the certificate. On 29.01.2025, the petitioner made a representation to the 4 th respondent along with appropriate fee and documents for obtaining a new birth certificate of her daughter with inclusion of her name in the birth certificate and

the same is not considered and hence, the present writ petition has filed.

3. The learned counsel for the petitioner submitted that this Court may issue a direction to the 4 th respondent to consider the petitioner's representation and pass appropriate orders within the stipulated time as fixed by this Court.

4. The learned Government Advocate for the respondents submitted that the petitioner's representation will be considered by the first respondent and there is no legal impediment to include the petitioners daughter's name in the certificate within the stipulated time as fixed by this Court.

5. Heard the learned counsel for the petitioner and the Government Counsel and perused the materials available on record. Since no adverse orders are passed against the 4 th respondent and hence, notice to the 4 th respondent is dispensed with.

6. Considering the facts and circumstances of the case and having regard the submissions made by the learned counsel on either side, this Court directs the 4 th respondent to include the name of the petitioner's daughter in the birth certificate by considering the representation of the petitioner within a period of four weeks from the date of receipt of a copy of this order.

7. With the above direction, the writ petition stands disposed of.
