This petition has been filed seeking to condone the delay of 122 days in filing the above Revision against the order dated 07.01.2021 in E.P. No. 20 of 2017 in I.A.No. 3238 of 2012 in O.P. No. 3197 of 2011 on the file of learned III Addl. Family Court, Chennai.
2. Mr.D.Nandhagopal, learned counsel for petitioner submitted that the copy of order was made ready on 16.02.2022 and it was delivered on 18.02.2022. He would submit that as the petitioner is a deserted woman and taking care of by her mother, she was not aware of the proceedings of the court and she is also unable to meet out expenses towards filing of a case. Hence, she is unable to file the above petition in time. However, there is a delay of 122 days arose in filing the above C.R.P. and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.
3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one. Accordingly, this court is inclined to allow this petition and Registry is directed to number the Civil Revision Petition if it is otherwise found to be in order and post the matter for admission on 27.03.2023.
