PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the first respondent to dispose of the representation dated 19.10.2024 pending on the file of the first respondent in accordance with law. For Petitioner :

Seeking a Mandamus to the first respondent to dispose of her representation dated 19.10.2024, the petitioner is before this Court. 1/4

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader accepting notice for the first respondent.

3. The brief facts leading to filing of this writ petition are as follows :

(i) The property measuring 4,820 sq.ft in old S.No.41/3 and new S.No.41/5, Bharathiyar Street, Pammal Village, Alandur Taluk, Kanchipuram District was owned by the petitioner's grandfather - one Mr.Pammal M.James. The said property was used for religious services and ministry work under his leadership. The petitioner's grandfather died on 01.6.1987 leaving behind 3 Class I heirs and 15 Class II heirs. The family has been in possession of the said property for over 25 years.

(ii) In the recent past, the petitioner came to know that without their consent or notice to the legal heirs of the said late Mr.Pammal M.James, the patta in respect of the said property namely patta No. 4985 was transferred in the name of the second respondent. Hence, the petitioner sent a representation dated 19.10.2024 to the first respondent requesting cancellation of the patta issued to the second respondent and re-transfer the same in the names of the legal heirs of 2/4

the said Mr.Pammal M.James. However, there has been no inquiry conducted by the first respondent to date.

4. Considering the limited nature of the relief sought, the writ petition is allowed and a Mandamus is issued to the first respondent to dispose of the representation of the petitioner dated 19.10.2024 within a period of three months from the date of receipt of a copy of this order. No costs.
