IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED: 23.11.2023 CORAM :

THE HON'BLE MR.SANJAY V.GANGAPURWALA, CHIEF JUSTICE AND THE HON'BLE MR.JUSTICE D.BHARATHA CHAKRAVARTHY Contempt Petition No.2800 of 2023 S.Ravi Selvan .. Petitioner Vs Sanjay Kumar Agarwal, I.R.S., Chairman, Central Board of Indirect Taxes & Customs, North Block, New Delhi-110 001.

.. Respondent Prayer: Petition filed under Section 11 of the Contempt of Courts Act to punish the respondent for willful disobedience of the orders passed by this Court dated 3.11.2022 in W.A.No.2388 of 2022 and C.M.P.No.18244 of 2022.

For the Petitioner : Mr.M.Ravi For the Respondent : Mr.AR.L.Sundaresan Addl. Solicitor-General for Mrs.Hemalatha Standing Counsel

ORDER

(Order of the court was made by the Hon'ble Chief Justice) We have heard Mr.M.Ravi, learned counsel for the petitioner; and Mr.AR.L.Sundaresan, learned Additional Solicitor-General for Mrs.Hemalatha, learned Standing Counsel for the respondent.

2. Learned counsel for the petitioner submits that the complaint against the petitioner is stayed by this Court under the order dated 3.11.2022 passed in the writ appeal. However, the respondent, even thereafter, has extended the order of suspension. The same is against the spirit of the order of this Court.

3. The stay of the complaint would not ipso facto revoke the suspension order. Further enquiry pursuant to the complaint is stayed. The order of suspension was already effectuated before the complaint was stayed.

4. In the light of that, we cannot fathom the contention of the petitioner of contempt being committed because of the continuation of

the suspension order. It is for the petitioner to take appropriate steps in appropriate proceedings.

5. The contempt petition is disposed of accordingly. There will be no order as to costs.
