It is stated that final report had been filed before the Special Judge for POCSO cases, Karaikal.

2.Let the evidence of the victim child be examined and thereafter, the application can be considered for seeking bail. Since the evidence has to be examined, it may not appropriate on my part to entered into a detailed discussion on the nature of statement made under Section 164(5) Cr.P.C.

3.Accordingly, the petition stands dismissed with liberty to file a fresh application immediately after the victim child is examined as witness.
