ORDER
Heard the learned counsel, appearing on behalf of the petitioner, as well as the learned counsel, appearing on behalf of the respondent.
2. This writ petition has been filed challenging the show cause notice issued by the General Manager (Administration) of the Government State Express Transport Corporation (Tamilnadu) Ltd., Pallavan Road, Chennai - 600 012 dated 15.05.2004.
3. The contention of the writ petitioner is that he was working as Telephone Operator in the State Express Transport Corporation (Tamilnadu) Ltd., and he was an office bearer in the Employees Express Building Society Ltd., in which the employees of the State Express Transport Corporation are the members. He was elected as a Director to manage the affairs of the cooperative society and it seems that there were some https://hcservices.ecourts.gov.in/hcservices/
irregularities committed in the affairs of the society. An action was taken against the directors of the co-operative society, consequent to that the respondent/management issued a show cause notice to the writ petitioner setting out the charges and directing him to submit an explanation within a period of seven days from the date of receipt of the show cause notice.
4. The order under challenge is a show cause notice providing an opportunity to the writ petitioner to submit his explanation within the period stipulated therein. Therefore, the writ petitioner ought to have submitted his explanation as per the show cause notice and only thereafter, he can make out a case. Even prior to the submission of the explanation as sought for by the respondent/management the present writ petition is filed which is to be construed as premature.
5. Accordingly, the Writ Petition is dismissed as premature. No order as to cost.
