ORDER

Aggrieved by the award passed by the first respondent / the Presiding Officer, Labour Court, Cuddalore, in I.D.No.226 of 1992, dated 13.02.2002, the petitioner management has filed the present writ petition.

2. No one appeared on behalf of the petitioner management, despite several opportunities given to them to defend their case. Learned counsel appearing for the second respondent submitted that, during the pendency of the writ petition, the second respondent passed away.

It is seen that the Labour Court, after perusing the entire materials placed before it, set aside the order of termination directing the petitioner management to reinstate the petitioner with backwages. It is also seen that the allegation against the second respondent was that he misappropriated a sum of Rs.2/-, as he did not issue tickets to the passengers after receiving such amount and that the said allegation also properly answered by the Labour Court upon perusing the materials placed before it. Therefore, this Court is not inclined to interfere with the impugned award. Accordingly, the writ petition fails and the same is dismissed. No Costs.
