C.M.P.No.22298 of 2022 in C.M.A.SR.No.139525 of 2022 N.MALA,J, This Petition has been filed to condone the delay of 85 days in filing the above appeal against the order dated 21.04.2022 made in M.C.O.P.No.661 of 2018, on the file of the Motor Accidents Claims Tribunal Special District Court, Erode.

2.The learned counsel for the appellants made an endorsement that the respondents one and two remained ex-parte before the Court below, hence notice may be dispensed with. Though notice was served to the respondents, three and four, they have not appeared in person or through counsel before the Court.

3. I have gone through the affidavit in support of the petition and I am satisfied with the reasons stated therein, therefore, the delay of 85 days is condoned.

4. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same for admission.

Accordingly, this CMP is ordered.
